41. BY-LAWS, CONDITIONS OF PLAY AND POLICIES

The Board may make, repeal, amend or alter such By-Laws and Policies as considered necessary for the proper conduct of the operations of the Association. Such By-Laws and Policies must be consistent with the Objects contained in Rule 4 of these rules [the constitution].

1. Rationale

1.1   For a variety of reasons a BTS Player Infringement Report of a player(s) misconduct is not always forwarded to BTS.

1.2   This policy covers instances where a BTS Player Infringement Report has not been sent to BTS and/or the BTS Board has not taken any action under clause 32.1 of the BTS Constitution.

1.3   This policy only deals with a club suspension of a player’s playing rights. It does not apply to non-bowls related suspensions.

2. Policy Guidelines

2.1   A club may take disciplinary action against its own playing members when the club’s Board of Management considers the club’s player code of conduct may have been breached.

2.2   The club’s disciplinary procedures should ensure that procedural fairness and natural justice is afforded the defendant(s) of any allegation.

2.3   Where a case of misconduct is proven a range of penalties can be imposed by a club, including (but not limited to) the suspension of the right to participate in bowls competition.

2.4   If a club imposes a suspension of playing rights, the club must report to BTS the name(s) of any suspended player(s). The report must include the period of the suspension and the date on which the suspension will cease. The report must be sent immediately the period of suspension has been confirmed.

2.5   On receipt of the report from the club the BTS Secretary will inform all BTS clubs, Bowls Tasmania and the other regional authorities of the name(s) of the player(s) and the period of their suspension.

2.6   Players under club suspension will not be eligible for entry into, or participation in, any sanctioned bowls event or bowls activity within Tasmania for the period of the suspension.

2.7   Players under club suspension will be denied the right to transfer their membership to another club during the period of their suspension.

2.8   The club must notify BTS of any changes or extensions to club suspensions immediately they take effect.
